1. Acceptance of Terms

By downloading, installing, or using the Elethu application ("App") or visiting our website, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Elethu provides a digital platform for managing stokvels — rotating savings groups. The Services allow users to:

• Create and manage stokvel groups
• Track and record member contributions
• Manage rotating payout schedules
• Communicate with stokvel members via in-app chat
• Manage funds through an in-app wallet

Important: Elethu is a management and coordination tool. We do not hold, manage, or guarantee funds. Financial disputes between stokvel members remain the responsibility of those members.

3. Eligibility

You must be at least 18 years of age to use our Services. By using Elethu, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms.

4. Account Registration

To use the App, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorised use of your account
• Take responsibility for all activities that occur under your account

5. User Conduct

You agree not to:

• Use the Services for any unlawful purpose
• Impersonate any person or entity
• Harass, threaten, or harm other users
• Transmit fraudulent or misleading information
• Attempt to gain unauthorised access to any part of the Services
• Use the Services to facilitate money laundering or financial crime

6. Financial Disclaimer

Elethu is not a bank, financial institution, or registered financial services provider in terms of the Financial Advisory and Intermediary Services Act (FAIS). We do not provide financial advice. Our Services facilitate record-keeping and coordination for self-organised savings groups.

All financial decisions made within a stokvel are the sole responsibility of the members of that stokvel. Elethu is not liable for any financial losses arising from the operation of any stokvel.

7. Intellectual Property

All content, features, and functionality of the Services — including the app design, logos, text, graphics, and software — are owned by Elethu and are protected by South African and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Elethu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our Services.

Our total liability to you for any claim arising from the use of our Services shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we reasonably believe to be harmful to the Services or other users. You may delete your account at any time from within the App settings.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Changes to Terms

We may amend these Terms at any time. We will notify you of significant changes via the App or email. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
